Terms of use
Last updated: [date of publication]
These terms apply when you use the Pianuance apps (iPhone, iPad, Android, web, Windows, macOS and Linux) and this website. Pianuance is offered by Holo Apps, [Street and number, postcode, city], the Netherlands, KvK number [KvK number, 8 digits] (“we”). By using Pianuance you agree to these terms. Our privacy policy explains how we handle your data.
Your account
- You can use Pianuance without an account. An account adds sync, leaderboards and teacher studios.
- Accounts are for people aged 13 or over. A younger child needs a parent or guardian to create and manage the account.
- Keep your sign-in details to yourself, and tell us if you think someone else is using your account.
- Choose a display name that isn't offensive, misleading or someone else's. It is shown to other users on the leaderboards and to your teachers. We may change or remove names that break this rule. You can report a name on a leaderboard, or a teacher's note, from the app.
- You can delete your account at any time in the app (tap the round profile button at the top right, then your name, then Delete account). How deleting works.
Pianuance Pro
- Some features are part of Pianuance Pro, a paid subscription bought in the App Store or Google Play. The price is shown in the app before you buy.
- Subscriptions renew automatically at the end of each period until you cancel. Cancel in your App Store or Google Play account settings, at least 24 hours before the period ends; you keep Pro until then.
- The yearly plan can start with a 7-day free trial. If you cancel before the trial ends, you aren't charged. Otherwise the first year is charged when the trial ends.
- If a one-time purchase of Pro is offered, it unlocks Pro for as long as Pianuance is offered.
- Payments, cancellations and refunds are handled by Apple or Google under their terms. We can't issue refunds for store purchases ourselves.
- Pro is tied to your Pianuance account, so it also works on the web and desktop apps when you sign in with the same account.
- Purchases in the App Store are also subject to Apple's Licensed Application End User License Agreement; where it and these terms differ, these terms apply as far as Apple allows.
Your music and files
- The pieces in the Pianuance library are in the public domain or used under their licence (listed in the app under Settings, About). The arrangements and exercises are ours.
- Files you import, record or write stay yours. Only import music you have the right to use. You allow us to store and process your files only to provide Pianuance to you (for example to sync them, or to turn a PDF into a score).
- Teachers: you are responsible for the pieces you share with your students, and for having any consent you need from your students (or their parents) to follow their practice.
Recognition and grading
Turning a PDF, a photo or a recording into a score, following your playing and grading it are done automatically and can contain mistakes. Check an imported score before you rely on it. Exam-style tests are written in the style of ABRSM, Trinity College London and RCM grades; Pianuance is not affiliated with or endorsed by these organisations, and our results don't predict a real exam result.
Fair use
Don't misuse Pianuance: don't try to break or overload it, get into other people's data, cheat on the leaderboards, or use it to harm others. We may remove leaderboard results, or suspend an account, that breaks these rules.
Availability and changes
We work to keep Pianuance running and improving, but we can't promise it will always be available or free of errors. Features may change. If we stop offering Pianuance, we will tell you in advance where we can, and paid subscriptions stop renewing.
Liability
We are responsible for damage we cause intentionally or through gross negligence, and as far as the law requires otherwise. Beyond that, and as far as the law allows, we are not liable for indirect damage, such as lost data on your devices. Nothing in these terms limits your rights as a consumer under the law of the country where you live.
Changes to these terms
We may update these terms. We change the date at the top, and if the changes are significant we tell you in the app before they apply. If you don't agree, you can stop using Pianuance and delete your account.
Law
These terms are governed by Dutch law. Disputes go to the competent court for Amersfoort (Rechtbank Midden-Nederland), the Netherlands, unless the law gives you as a consumer the right to go to the courts where you live. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of that country.
